For our readers in the UK, it is important to state that your compliance is only necessary if you sell goods or services to customers within the EU. <\/p>\n\n\n\n<hr class=\"wp-block-separator has-text-color has-webgainslightergrey-color has-alpha-channel-opacity has-webgainslightergrey-background-color has-background\"\/>\n\n\n\n<h2 class=\"has-webgainspink-color has-text-color\">For our readers in the UK, it is important to state that your compliance is only necessary if you sell goods or services to customers within the EU. <\/h2>\n\n\n\n<hr class=\"wp-block-separator has-text-color has-webgainslightergrey-color has-alpha-channel-opacity has-webgainslightergrey-background-color has-background\"\/>\n\n\n\n<p class=\"has-medium-font-size\">Within this article, we&#8217;ll take a closer look at what the Omnibus Directive is and answer some common questions from an affiliate marketing perspective.<\/p>\n\n\n\n<div style=\"height:35px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3>Background<\/h3>\n\n\n\n<p>Also known as the Enforcement and Modernisation Directive, the Omnibus Directive is comprised of four pieces of consumer legislation:<\/p>\n\n\n\n<ol><li>The Consumer Rights Directive<\/li><li>The Price Indications Directive<\/li><li>The Unfair Contract Terms Directive<\/li><li>The Unfair Commercial Practices Directive<\/li><\/ol>\n\n\n\n<p><a href=\"https:\/\/eur-lex.europa.eu\/eli\/dir\/2019\/2161\/oj\" target=\"_blank\" rel=\"noreferrer noopener\">Click here to access the Directive in full.<\/a><\/p>\n\n\n\n<p>These four legislations above aim to expand the scope of the consumer rights framework to include digital services and goods. <\/p>\n\n\n\n<div style=\"height:35px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3>Who is affected by the Omnibus Directive, and why is it more relevant today than ever before?<\/h3>\n\n\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>Both Publishers and Advertisers are affected by this Directive.<\/p>\n\n\n\n<p>As an Advertiser retailing online, you are probably already aware of the <a href=\"https:\/\/ec.europa.eu\/info\/law\/law-topic\/consumer-protection-law\/unfair-commercial-practices-law\/price-indication-directive_en\" target=\"_blank\" rel=\"noreferrer noopener\">Price Indication Ordinance<\/a> (PAngV) &#8211; part of the Omnibus Directive. It is <em>this <\/em>Directive which &#8211; as of 28th May 2022 &#8211; has been updated.  <\/p>\n\n\n\n<p>Most importantly, this update concerns discount campaigns, whereby, on the occasion that an online retailer wishes to display a discounted strike price (using a practise known as <a href=\"https:\/\/blog.hubspot.com\/ecommerce\/setting-ecommerce-prices-psychology-sales\" target=\"_blank\" rel=\"noreferrer noopener\">price anchoring<\/a>), they are legally required to match the sale price with their lowest price for that item 30 days prior to the application of the price reduction. <\/p>\n\n\n\n<p>In practice, therefore, an item&#8217;s lowest price from the last 30 days must now be used for the calculation of the discount. It will no longer be possible for traders to publicise a sale price as a discount when, in reality, they may have recently hiked the original cost up just to make it seem as such.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-text-color has-webgainslightergrey-color has-alpha-channel-opacity has-webgainslightergrey-background-color has-background\"\/>\n\n\n\n<h2 class=\"has-webgainspink-color has-text-color\">It will no longer be possible for traders to publicise a sale price as a discount when, in reality, they may have recently hiked the original cost up just to make it seem as such.<\/h2>\n\n\n\n<hr class=\"wp-block-separator has-text-color has-webgainslightergrey-color has-alpha-channel-opacity has-webgainslightergrey-background-color has-background\"\/>\n\n\n\n<p>As with GDPR, the penalty for failing to comply is severe and could be a fine of up to 4% of a seller&#8217;s annual turnover.<\/p>\n\n\n\n<div style=\"height:35px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3>Are all discounts affected?<\/h3>\n\n\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>In particular, the new regulation relates to price comparisons and percentage price reductions.<\/p>\n\n\n\n<p>In the case of price comparisons (e.g. \u20ac 8.50 instead of \u20ac 10), the comparative price must be the cheapest of the last 30 days. As per the updated EU Directive, sale prices listed must match the lowest price for the item from the past 30 days.<\/em><\/figcaption><\/figure>\n\n\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>Contingent upon price reductions, promotions are possible in which retailers announce percentage discounts online either directly on the price or via an advertising banner, and only make the deduction in the shopping cart (e.g. 20% on everything). <\/p>\n\n\n\n<div style=\"height:35px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3>What prices are <span style=\"text-decoration: underline;\">not<\/span> affected?<\/h3>\n\n\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<ul><li>Comparisons with the recommended retail price only remain unaffected by the Omnibus Directive<\/li><li>The mere indication of the reduced price without specifying a previous price <\/li><li>If there are individual discounts, it is not necessary to mention the lowest price of the last 30 days.<\/li><li>Perishable goods can be marked as reduced even without a price comparison<\/li><li>Relative price statements such as &#8220;sale&#8221; or &#8220;rock bottom price&#8221; do not need to be explained in more detail<\/li><li>Free gifts have no relation to the previous purchase prices, and therefore do not require special treatment<\/li><li>Goods measured in running meters, square meters or cubic meters such as flooring, do not have to be labelled differently <\/li><\/ul>\n\n\n\n<div style=\"height:35px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3>What should I do as a Publisher?<\/h3>\n\n\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>As a Publisher, you can continue to promote your Advertiser partner&#8217;s campaigns. If you mention the discount of a product, pay attention to the correct comparison price. The Advertiser should hand this over to you in their <a href=\"https:\/\/www.webgains.com\/public\/en\/what-is-a-product-feed\/\" target=\"_blank\" rel=\"noreferrer noopener\">product data feed<\/a>, or alternatively use the MSRP, which must be specified by the Advertiser.<\/p>\n\n\n\n<div style=\"height:35px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3>What should I do as an Advertiser?<\/h3>\n\n\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>As an Advertiser, you should update your <a href=\"https:\/\/www.webgains.com\/public\/en\/what-is-a-product-feed\/\" target=\"_blank\" rel=\"noreferrer noopener\">product data feeds<\/a> as soon as possible and add the correct comparison prices, so that your publishers can continue to promote your goods and services reliably.
